Continuing on from our Back to Basics Series on Helpful Timelines, this mailshot focusses on the timeline surrounding Adjudication.
The diagram below represents a simplified version of the timeline surrounding Adjudication:
Under the ''Construction Act'' and Scheme for Construction Contracts any party can commence an Adjudication at any time, providing that a dispute has crystallised.
The Adjudicator is to reach their decision within 28 days, following the service of the Notice of Intention to Adjudicate. This can be extended by 14 days with the consent of the Referring Party, any further extension must be agreed by both parties.
