Interim Payment Timelines under JCT
Continuing our Back to Basics Series on payment timelines under different forms of Contract, today’s diagrams are for the Interim Payment under the JCT Design & Build (DB) Contract.
The diagram below represents, in a simplified way, the Interim Payment Timeline under the JCT Design & Build 2016 Contract:
The JCT Design and Build Contract specifies a period of 14 days from the Due Date to the Final Date for Payment. Alongside specifying the general period applicable to Interim Payment, the Contract also specifies the timescales applicable for the issuing of Payment Notices and Pay Less Notices. It is important that parties are aware of these periods, as failure to issue the relevant Notice in time could result in the Employer being obliged to pay the sum stated in the Contractor’s Interim Application.
